This Privacy Policy describes how Brightside Benefit, Inc. (“Brightside,” “we,” “us,” or “our”) collects, uses, discloses, retains, and protects Personal Information in connection with the Brightside mobile and web application and our related support services, including communications with Brightside Financial Assistants by app, phone, email, and text message (collectively, the “Services”).


We know financial information is personal. We handle Personal Information with care and use it to provide, secure, support, and improve the Services, to communicate with you, to comply with law, and for the other purposes described in this Privacy Policy.


For California residents, this Privacy Policy is also intended to provide the notice at collection required by California law.


This Privacy Policy applies to information we collect from you, about you, from your employer or another sponsoring organization, from service providers and contractors acting on our behalf, and from third parties you direct us to connect with or share information with in order to provide a service you request.


If your access to the Services is sponsored by your employer or another organization, that organization may provide us with information reasonably needed to verify eligibility, create and maintain your account, personalize the Services, and provide support. We treat information your employer provides to us as Personal Information associated with your account and protect it as described in this Privacy Policy. Your employer’s own privacy practices govern its collection and disclosure of information to Brightside.


This Privacy Policy does not apply to information collected directly by third-party websites, applications, banks, lenders, or other services that are not operated by Brightside, even if you access them through a link or referral in the Services.


CHANGES TO THIS PRIVACY POLICY

The Effective Date of this Privacy Policy is set forth at the top of this page. As we add new features to the Services, we may amend this Privacy Policy. If we make a material change to this Privacy Policy that reduces your privacy rights, we will notify you at least 10 days in advance through the Services and/or by email so that you have time to stop using the Services before the amended Privacy Policy is in effect. Your continued use of the Services after the Effective Date constitutes your acceptance of the amended Privacy Policy. The amended Privacy Policy supersedes all previous versions.

INFORMATION WE COLLECT

Depending on how you use the Services, we may collect the following categories of Personal Information:

  • Identifiers and contact information, such as name, username, postal address, email address, telephone number, employee identifier, and account credentials.
  • Eligibility and account information, such as employer sponsorship status, account settings, preferences, and records relating to your use of Brightside features.
  • Financial profile and support information, such as information you provide about your financial situation, goals, obligations, income, expenses, savings, benefits, and the topics you ask us to help with.
  • Communications information, such as email, text, chat, call notes or recordings where used, and records of your interactions with Brightside Financial Assistants and customer support.
  • Device, log, and usage information, such as IP address, browser type, device identifiers, operating system, app version, pages and features used, timestamps, and crash or performance information.
  • Location information, such as approximate location derived from IP address and, if you enable it, more precise geolocation information from your device.
  • Partner and transaction-support information, such as information received from banks, lenders, and other partners when you ask us to connect to or facilitate a service with them.

Some of the information we collect may be considered Sensitive Personal Information under certain privacy laws, such as account credentials, financial account information, precise geolocation, and the contents of certain communications. We do not use or disclose Sensitive Personal Information to infer characteristics about you. We use Sensitive Personal Information only to provide the Services, maintain security, prevent fraud, comply with law, and for other permitted business purposes.

 

SOURCES OF PERSONAL INFORMATION

We collect Personal Information directly from you; from your employer or another sponsoring organization; from your device and browser when you use the Services; from service providers and contractors that help us operate, secure, and support the Services; from banks, lenders, and other third parties when you ask us to connect with them or authorize information sharing; and from publicly available sources when relevant to verify information, prevent fraud, or support lawful business operations.

 

COOKIES AND SIMILAR TECHNOLOGIES

We use cookies, SDKs, pixels, and similar technologies to operate the Services, remember your settings, understand how the Services are used, improve performance, prevent fraud, and support security.


We do not use these technologies to sell your Personal Information or to share your Personal Information for cross-context behavioral advertising.


We may use analytics providers and similar vendors to help us understand usage of the Services. When we do, those providers act on our behalf and are restricted by contract from using Personal Information for their own independent purposes except as permitted by law and necessary to provide their services to us.


You can control cookies through your browser or device settings, but some features of the Services may not function properly if you disable them.


HOW WE USE PERSONAL INFORMATION

We use Personal Information to verify eligibility and create, maintain, and service your account; provide the Services and respond to your requests; connect you with Brightside Financial Assistants and support communications; personalize your experience and help identify services, tools, and options that may be relevant to you; facilitate connections to third-party products or services you request; process and document your consents, instructions, and preferences; operate, troubleshoot, analyze, improve, and develop the Services; protect the Services, users, Brightside, and others against fraud, abuse, unauthorized activity, and security incidents; comply with legal, regulatory, contractual, and reporting obligations; and enforce our Terms, resolve disputes, and protect rights and property.


HOW WE DISCLOSE PERSONAL INFORMATION

Brightside has a no sale, no share policy. We do not sell Personal Information. We do not share Personal Information for cross-context behavioral advertising. We do not disclose Personal Information to third parties for their own advertising or marketing purposes.


We disclose Personal Information to service providers and contractors that perform services for us, such as cloud hosting, customer support, communications delivery, analytics, fraud prevention, identity verification, security, and technical operations. These parties are authorized to use Personal Information only on our behalf, for the services we request, and in accordance with contractual restrictions and applicable law.


If you ask us to connect you with a bank, lender, servicer, benefits provider, or other third party, or if you authorize us to share information needed to facilitate a product or service you request, we will disclose the information reasonably necessary to carry out your instruction.


We may also disclose Personal Information in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, subject to customary confidentiality and legal protections, and when we reasonably believe disclosure is necessary to comply with law, legal process, or regulatory requirements; to protect the rights, safety, and security of users, Brightside, or others; to investigate fraud or misuse; or to enforce our agreements.
We may use and disclose de-identified or aggregated information that does not reasonably identify an individual.

 

YOUR PRIVACY RIGHTS

Depending on where you live, you may have privacy rights under applicable law, including the right to know whether we process your Personal Information, request access to or a copy of your Personal Information, request correction of inaccurate Personal Information, request deletion of Personal Information, appeal certain decisions about your privacy requests, and receive equal service and pricing when exercising your rights, as provided by law.


California residents may also request information about the categories of Personal Information we collect, the sources of that information, the business or commercial purposes for collection, use, or disclosure, and the categories of third parties to whom we disclose Personal Information.


Because Brightside does not sell Personal Information or share Personal Information for cross-context behavioral advertising, we do not offer a Do Not Sell or Share right at this time. If our practices materially change, we will update this Privacy Policy and any required notices.


Some California residents may have the right to limit certain uses or disclosures of Sensitive Personal Information. Brightside uses Sensitive Personal Information only for permitted purposes described in this Privacy Policy and does not use it to infer characteristics about you.

You may authorize someone to submit a privacy request for you. We may ask for proof of that authority and may verify your identity directly with you before completing the request.

Text Messages and Calls


When you provide your mobile number and opt in where required, we may send you transactional, servicing, and account-related text messages or calls, including by automated technology where permitted by law. We maintain records of your phone number, your consent choices, the content and timing of messages, and delivery or opt-out records as needed to provide the Services and comply with law.


Your consent to receive text messages is not required as a condition of using the Services. Message frequency varies based on your interactions with us. Message and data rates may apply.


You may revoke consent at any time by replying STOP, QUIT, END, CANCEL, UNSUBSCRIBE, or OPT OUT, or by using any other reasonable method that clearly communicates your request to stop. After you opt out, we may send a one-time confirmation message as permitted by law.


You may also opt out of push notifications through the Brightside App by adjusting the permissions on your mobile device.

 

LINKED SERVICES

The Services may include links, referrals, integrations, or connections to products and services offered by banks, lenders, servicers, and other third parties (“Linked Services”). It is always your choice whether to engage with a Linked Service. If you choose to do so, and if you authorize us to share information needed to facilitate that request, Brightside may share the limited information necessary to support the application, referral, activation, servicing, or related transaction you requested. If you decide to visit or use a Linked Service, you are subject to that third party’s own terms, disclosures, and privacy practices.


PROTECTION OF PERSONAL INFORMATION

We use administrative, technical, and physical safeguards designed to protect Personal Information appropriate to the nature of the information and the risks involved. These measures may include access controls, authentication safeguards, encryption in transit and at rest where appropriate, logging and monitoring, vendor security review, and workforce training.


Security practices evolve over time, and we may update our safeguards as technology, threats, legal requirements, and our business change. Although no system can be guaranteed to be completely secure, we work to protect Personal Information and to review and improve our safeguards over time.


If you believe information you provided to us is no longer secure, please notify us immediately using the contact information below.

 

CHILDREN’S PRIVACY

The Services are not directed to children under 13, and Brightside does not knowingly collect Personal Information directly from children under 13 for use of the Services. If we learn that we have collected Personal Information from a child under 13 in a manner that requires deletion under applicable law, we will take appropriate steps to delete it.
Brightside may permit certain eligible teen users ages 13 through 17 to access some Services where permitted by our eligibility rules, applicable customer arrangements, and applicable law. Additional account, consent, or feature restrictions may apply to teen users.

 

DATA RETENTION

We retain Personal Information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain your account, comply with legal and regulatory obligations, resolve disputes, enforce agreements, prevent fraud, and keep appropriate business and financial records.


In general, account registration, eligibility, and profile information is retained while your account is active and for a reasonable period afterward; communications, support records, and consent records are retained for as long as needed to support the Services, document interactions, and comply with legal obligations; device, log, and analytics information is retained for shorter periods unless needed for security, fraud prevention, troubleshooting, or legal compliance; and information relating to financial products, transactions, or account features may be retained for longer periods where required by applicable law, bank-partner requirements, tax or accounting rules, or dispute-resolution needs.


We may also retain de-identified or aggregated information for analytics, service improvement, and lawful business purposes.

If you have an account with us, you may close your account at any time by contacting us at clientservices@gobrightside.com or messaging us in the app. Brightside may retain certain information associated with your account as permitted by law and as described in this Privacy Policy.


Brightside is headquartered in the United States, and the Services are intended for U.S. users. Personal Information may be processed and stored in the United States, which may have privacy laws that differ from those where you live.
